Is It a Deeded Timeshare or a Right-to-Use Membership?
Royal Resorts memberships are structured as Right-to-Use (RTU), based in Mexico. As a foreign buyer, you generally can’t own Mexican coastal property outright, so you’re purchasing access rights for a set term instead. This matters because it changes your risk profile: Royal Resorts can’t foreclose on a property you don’t legally own, though they can still pursue unpaid balances through other means.
Are You Still in Your Rescission Period?
If you just signed, act fast. Mexican federal law gives you just 5 business days to cancel for a full refund, under Article 65 of the Federal Consumer Protection Law.
To rescind, send a written letter by registered mail to the company name and address listed in your contract — not just the resort you visited. Many owners send copies to both addresses, plus an email with PROFECO (Mexico’s consumer protection agency) copied, as extra protection.
Do this in writing only. Verbal cancellation, even in person, won’t hold up without documentation.
What If You Missed the Rescission Window?
Once those 5 days pass, cancellation becomes more complex, but it’s still possible.
Because Royal Resorts contracts are governed by Mexican law, not U.S. law, the process looks different from a Wyndham or Marriott exit:
- PROFECO complaint: You can file a formal complaint if the resort refuses to honor a valid rescission or misrepresented terms during the sale.
- Structured documentation approach: A properly prepared cancellation package, addressing the correct legal entity named in your contract, gives you the best chance at a response.
- Professional cancellation support: Because contracts are often in Spanish and disputes go through a different legal system, having someone who understands Mexican timeshare structures matters.
